Alpha 3 provided dispute resolution and expert testimony to the electrical and mechanical prime contractors and two mechanical subcontractors on this $50 million project, constructed for the New Jersey Department of Military and Veterans Affairs. Alpha 3 performed a delay analysis of the project CPM schedules using a windows analysis method that followed the observational / dynamic / contemporaneous split protocols outlined in AACE International’s Recommended Practice for Forensic Schedule Analysis (RP 29R-03). Alpha 3 also performed measured-mile analyses of the contractors’ productivity, performed a corresponding cost analysis, and developed requests for equitable adjustment based on the change order provisions of the contract. Claimed costs included labor and material escalation, additional direct labor, additional supervision, equipment, site logistics, insurances, bonding, and contractual mark-ups. When contract negotiations failed to resolve the dispute, Alpha 3 provided litigation support, including expert reports and expert testimony based on its analyses. After several days of trial, the State offered a settlement that was accepted by the contractors.
